Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of EnforceIQ Labs (the "Service"), operated by Hypernest Innovations LTD("we", "us", "our"), a company registered in England and Wales.

By creating an account, subscribing, or otherwise using the Service, you agree to our Terms of Service, Subscription Terms, and our Privacy notice. If you do not agree, do not use the Service.

Fleet customers may also be subject to a separate data processing agreement for driver data processed on their instructions.

2. The Service

EnforceIQ Labs is a software platform that helps drivers and fleet operators organise penalty charge notice (PCN) workflows — including notice tracking, deadline reminders, appeal preparation tools, and related compliance features.

• We provide workflow software only. We do not provide legal advice.
• We do not pay penalties on your behalf, guarantee appeal outcomes, or act as your legal representative.
• You remain responsible for meeting statutory deadlines and paying penalties on official council or authority portals.
• Features may change as we improve the product. We will not remove core paid features without reasonable notice during an active paid term.

3. Accounts and eligibility

You must be at least 18 years old and able to enter a binding contract. You are responsible for keeping your sign-in credentials secure and for all activity under your account.

Fleet administrators are responsible for inviting users lawfully and for ensuring they have a valid basis to process driver personal data under UK GDPR.

4. Acceptable use

You agree not to:

• Use the Service for unlawful, fraudulent, or abusive purposes
• Upload malware, attempt unauthorised access, or probe our systems
• Reverse engineer or resell the Service except as expressly permitted
• Misrepresent your identity or authority to act for another person or organisation
• Use automated means to scrape or overload the Service without our written consent

We may suspend or terminate access for material breach, risk to other users, or legal requirement.

5. Your content

You retain ownership of notices, uploads, and other content you submit. You grant us a limited licence to host, process, and display that content solely to provide the Service and as described in our Privacy notice.

You represent that you have the right to upload content you provide and that it does not infringe third-party rights.

6. Intellectual property

We own the Service, branding, software, and documentation. These Terms do not transfer any intellectual property rights to you except the limited right to use the Service during your subscription.

7. Disclaimers

The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation. AI-assisted features produce drafts and suggestions only — you must review outputs before relying on them.

8. Limitation of liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

Subject to the above, our total aggregate liability arising out of or relating to the Service in any twelve-month period is limited to the greater of (a) the fees you paid us in that period or (b) £100.

We are not liable for indirect, consequential, or special losses, including lost profits, penalties, or appeal outcomes.

9. Changes

We may update these Terms from time to time. When we make material changes, we will publish a new version and may require you to accept the updated Terms before continuing to use paid features. The version number and date at the top of this page indicate the current Terms.

10. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where mandatory consumer protection laws in your country of residence give you additional rights.
